The Florida legislature has passed a bill that would ban delta-8 THC and several other hemp-derived cannabinoids in the state. If Governor Ron DeSantis signs SB 1698 into law, the ban would take effect on October 1, 2023, making Florida the 25th state to restrict or prohibit delta-8 products.

In addition to delta-8, the legislation outlaws HHC, delta-10 THC, THC-O, THCP, THCV, and all synthetic cannabinoids. It sets allowable limits for delta-9 THC in hemp products, raises the minimum purchase age to 21, bans packaging that appeals to children, and prohibits hemp products resembling snacks or candy.

The bill passed both chambers of the legislature with mostly bipartisan support on March 6. Governor DeSantis has not indicated whether he will sign it. Proponents dismissed concerns that the ban would drive delta-8 users to the illicit market, characterizing the cannabinoids as recreational drugs.

The ban would impact numerous Florida businesses involved in the booming market for hemp-derived cannabinoids, which offer milder psychoactive effects than marijuana-derived delta-9 THC. Meanwhile, the Florida Supreme Court is reviewing a potential ballot measure to legalize recreational marijuana, which DeSantis opposes but acknowledges is likely inevitable. The court will decide on the initiative by April 1.
